  • Expert panelists are acting as agents of the Board and as such you are immune from damages for any opinion you render.
  • Although you are immune from damages, you are not immune from being sued. The immunity granted to agents of the Board provides you with an absolute defense for damages if you are acting in good faith and no malice can be established in your actions.
  • In order to maintain this immunity, you must refrain from discussing the case with anyone outside of the agency. This means that you should not discuss the case with your friends, your colleagues, or the news media.
  • If you are sued, please notify the agency General Counsel immediately. As soon as the agency is made aware of the lawsuit, we will ask the Texas Attorney General to intervene on your behalf.
